Client data in Switzerland

A fiduciary handles data that is not its own: the payroll, turnover and accounting records of its clients. Anyone carrying out audit mandates is additionally bound by confidentiality under Art. 730b para. 2 CO and professional secrecy under Art. 321 SCC. Data residency is therefore a question you must answer to every client — and one that belongs in the data processing agreement, not merely on the vendor’s website.
